1. Acceptance of Terms

By accessing and using Hero Servers services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Hero Servers provides web hosting, VPS hosting, dedicated servers, domain registration, game server hosting, and related services. Hero Servers services include:

  • Shared web hosting with cPanel/Webuzo control panels
  • Virtual Private Servers (VPS) and dedicated servers
  • Domain registration and management services
  • Radio hosting with SonicPanel
  • YouTube automation and content management
  • Game server hosting with Pterodactyl panel
  • Minecraft, FiveM, and other game server solutions
  • Technical support and customer service

3. Account Registration

To use our services, you must:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Be at least 18 years old (required by payment processor)
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized use

4. Payment Terms

Billing and Payments

  • All prices are in Canadian Dollars (CAD) unless otherwise specified
  • Payment is due in advance for the selected billing cycle
  • We accept payments via Stripe (credit/debit cards)
  • Auto-payment can be enabled for automatic recurring billing (requires saved payment method)
  • Failed payments may result in service suspension

Auto-Payment Requirements

  • Auto-payment requires a valid payment method saved to your account
  • Payment methods are securely stored by Stripe, our payment processor
  • You can enable/disable auto-payment in your client portal
  • Failed auto-payments will trigger email notifications and retry attempts
  • Services may be suspended if auto-payment fails repeatedly

Refunds

  • 30-day money-back guarantee applies only to shared hosting plans
  • Domain registrations and setup fees are non-refundable
  • Refunds are processed to the original payment method
  • Refund requests must be submitted via support ticket

5. Acceptable Use Policy

You agree not to use our services for:

  • Illegal activities or content that violates applicable laws
  • Spam, phishing, or unsolicited bulk email
  • Malware, viruses, or malicious code distribution
  • Copyright infringement or intellectual property violations
  • Adult content, gambling, or illegal substances
  • Resource abuse or activities that impact server performance
  • Harassment, hate speech, or discriminatory content
  • Cryptocurrency mining or similar resource-intensive activities
  • Proxy services, TOR exit nodes, or anonymization services
  • File sharing or torrent hosting services
  • Botnet command and control operations
  • DDoS attacks or network scanning activities

Resource Usage Limits

  • CPU usage must not exceed 80% for more than 60 seconds
  • Memory usage must stay within allocated limits
  • Disk I/O operations should not impact other users
  • Network bandwidth usage should be reasonable for your plan
  • Database connections and queries must be optimized

Intellectual Property and Piracy

  • Nulled Scripts: No hosting of nulled, cracked, or modified commercial software
  • Warez Sites: No distribution of pirated software, games, movies, or music
  • Software Cracks: No keygens, patches, or license circumvention tools
  • Stolen Content: No hosting of content obtained without authorization
  • Copyright Infringement: No unauthorized use of copyrighted material
  • Trademark Violations: No unauthorized use of trademarks or brand names
  • DMCA Compliance: All content must comply with Digital Millennium Copyright Act
  • License Verification: We may request proof of licensing for commercial software

Prohibited Software and Content

  • Nulled WordPress themes, plugins, or commercial scripts
  • Cracked versions of cPanel, WHMCS, or other control panels
  • Pirated movies, TV shows, music, or streaming content
  • Stolen databases, leaked information, or hacked content
  • Counterfeit software or fraudulent licensing systems
  • ROM files, game emulators with copyrighted games
  • Academic papers, books, or publications without permission
  • Private or confidential documents obtained illegally

Enforcement and Penalties

  • Immediate Suspension: Accounts hosting pirated content will be suspended without notice
  • DMCA Takedowns: Content will be removed within 24 hours of valid DMCA notice
  • Repeat Offenders: Multiple violations result in permanent account termination
  • Legal Cooperation: We cooperate fully with law enforcement and copyright holders
  • No Refunds: Violations result in forfeiture of all paid services
  • Data Preservation: Account data may be preserved for legal proceedings

Game Server Specific Terms

  • Licensed Games Only: Game servers must use legally obtained game files
  • Server Modifications: Only authorized mods and plugins are permitted
  • Player Conduct: You are responsible for moderating player behavior
  • Resource Limits: Game servers must stay within allocated CPU and RAM limits
  • DDoS Protection: We provide basic DDoS protection but cannot guarantee immunity
  • Backup Responsibility: Regular backups of game data are your responsibility
  • Game Updates: Server updates and maintenance may cause temporary downtime
  • Community Guidelines: Game servers must comply with game publisher terms

Other Content Restrictions

  • No hosting of hate speech or discriminatory content
  • No content that promotes violence or illegal activities
  • No fraudulent schemes, scams, or deceptive practices
  • No content that violates privacy laws or regulations

6. Service Availability and SLA

Uptime Guarantees

  • Shared Hosting: 99.9% monthly uptime guarantee
  • VPS Hosting: 99.95% monthly uptime guarantee
  • Dedicated Servers: 99.99% monthly uptime guarantee
  • Game Servers: 99.9% monthly uptime guarantee
  • Radio Hosting: 99.9% monthly uptime guarantee
  • Uptime is calculated monthly excluding scheduled maintenance

Maintenance Windows

  • Scheduled maintenance: 72 hours advance notice via email
  • Maintenance window: Sundays 2:00 AM - 6:00 AM EST
  • Emergency maintenance may occur without notice for security
  • Maintenance time is excluded from uptime calculations

Service Credits

  • 99.0% - 99.89% uptime: 10% monthly service credit
  • 95.0% - 98.99% uptime: 25% monthly service credit
  • Below 95% uptime: 50% monthly service credit
  • Credits must be requested within 30 days of the incident
  • Credits are applied to your account, not refunded as cash
  • Service credits are your sole and exclusive remedy for any downtime

7. Data and Backups

While we perform regular backups, you are responsible for maintaining your own backups:

  • We provide backup services but do not guarantee data recovery
  • You should maintain independent backups of your data
  • We are not liable for data loss or corruption
  • Backup retention periods vary by service type

8. Account Suspension and Termination

Suspension Reasons

We may suspend your account for:

  • Violation of these Terms of Service or Acceptable Use Policy
  • Non-payment of fees (after 7 days past due date)
  • Excessive resource usage affecting server performance
  • Security threats or compromised accounts
  • Legal complaints or DMCA takedown requests
  • Fraudulent activity or chargebacks

Suspension Process

  • We will attempt to contact you via email before suspension
  • Emergency suspensions may occur without prior notice for security
  • Suspended accounts have 30 days to resolve issues
  • Services remain suspended until issues are resolved and fees paid

Termination and Data Retention

  • Accounts suspended for 30+ days may be terminated
  • You have 30 days after termination to retrieve your data
  • Data backups are permanently deleted after the retention period
  • We are not responsible for data loss after termination
  • Refunds are not provided for terminated accounts due to policy violations

9. Limitation of Liability

To the maximum extent permitted by law:

  • Our liability is limited to the amount paid for services in the past 12 months
  • We are not liable for indirect, incidental, or consequential damages
  • We do not warrant that our services will be uninterrupted or error-free
  • You use our services at your own risk

10. Intellectual Property

You retain ownership of your content, but grant us necessary rights to provide our services. You warrant that your content does not infringe on third-party rights.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Governing Law

These terms are governed by the laws of Ontario, Canada. Any disputes will be resolved in Ontario courts with jurisdiction over Hero Servers's business location.

13. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or account notifications. Continued use of our services constitutes acceptance of updated terms.
