1. Agreement Overview

This Terms of Service agreement ("Agreement") governs your relationship with Hero Servers ("Company," "we," "us," or "our") when using our hosting services, website, and related products ("Services"). By creating an account or using our Services, you ("Customer," "you," or "your") agree to these terms. If you disagree with any part of these terms, you must discontinue use immediately.

1.1 Additional Policies

Your use of our Services is also governed by our Privacy Policy, Acceptable Use Policy, and any service-specific agreements, which are incorporated into this Agreement by reference.

2. Service Description

Hero Servers provides web hosting, VPS hosting, domain registration, and related services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to customers.

3. Account Eligibility and Registration

3.1 Age and Authority Requirements

You must be at least 18 years old to register for our Services. If registering on behalf of a business or organization, you warrant that you have authority to bind that entity to this Agreement.

3.2 Accurate Information

You must provide truthful, current, and complete registration information, including a valid email address different from any domain you're registering with us. Providing false information may result in immediate account termination.

3.3 Account Security

You are fully responsible for maintaining account security and all activities under your account. We may require government-issued identification for verification purposes, especially for dedicated servers or high-value orders.

3.4 Multiple Account Restrictions

Creating multiple accounts to abuse new customer promotions is prohibited. Violating accounts will be suspended until all outstanding balances are resolved.

4. Acceptable Use Policy

You agree not to use our services for any of the following prohibited activities:

4.1 Illegal and Criminal Activities
  • Any illegal activities or content that violates federal, state, or local laws
  • Distribution of illegal drugs, weapons, or other contraband
  • Money laundering, fraud, or other financial crimes
  • Hacking, cracking, or unauthorized access to systems
  • Identity theft or impersonation
4.2 Intellectual Property Violations
  • Nulled or pirated software: Hosting, distributing, or using nulled, cracked, or pirated software is strictly prohibited
  • Copyright infringement including unauthorized distribution of movies, music, books, or software
  • Trademark violations or unauthorized use of branded content
  • Warez sites or file sharing of copyrighted materials
  • License key generators, cracks, or software activation tools
4.3 Malicious Activities
  • Hosting or distributing malware, viruses, trojans, or other malicious software
  • Phishing, scamming, or fraudulent schemes
  • Spamming, bulk email, or unsolicited communications
  • Botnet command and control servers
  • DDoS attacks or network abuse
  • Cryptocurrency mining without explicit permission
4.4 Restricted Content
  • Adult content, pornography, or sexually explicit materials
  • Gambling, betting, or casino-related services (where prohibited by law)
  • Hate speech, discrimination, or content promoting violence
  • Terrorist content or materials promoting extremism
  • Content that exploits minors in any way
4.5 Resource Abuse
  • Excessive CPU, memory, or bandwidth usage that affects server performance
  • Running scripts or applications that consume unreasonable resources
  • File storage services or backup services (unless specifically purchased)
  • Proxy services, VPN services, or anonymization tools
  • Game servers or high-resource applications without prior approval

5. Payment Terms and Refunds

5.1 Payment Requirements

All services must be paid in advance. We accept major credit cards, PayPal, and other approved payment methods. Prices are subject to change with 30 days notice to existing customers.

5.2 Billing Cycles and Auto-Renewal

Services are billed according to your chosen billing cycle (monthly, quarterly, annually). All services auto-renew unless cancelled before the renewal date. You are responsible for keeping payment information current.

5.3 Late Payments and Suspension

Accounts with overdue payments will be suspended after a 7-day grace period. Suspended accounts may be terminated after 30 days. A reactivation fee may apply for suspended accounts.

5.4 Refund Policy

We offer a 30-day money-back guarantee for new hosting accounts only. Refunds exclude:

  • Domain registrations and transfers
  • Setup fees and administrative costs
  • SSL certificates and third-party services
  • Accounts terminated for policy violations
  • Dedicated servers and VPS after initial setup

Refunds are processed within 7-10 business days to the original payment method.

5.5 Chargebacks and Disputes

Initiating a chargeback without contacting support first may result in immediate account termination. We reserve the right to charge a $25 fee for each chargeback processed.

6. Service Level Agreement and Technical Specifications

6.1 Uptime Guarantee

We guarantee 99.9% uptime for shared hosting and 99.95% for VPS/dedicated services. Uptime is calculated monthly excluding scheduled maintenance. SLA credits may be available for verified downtime exceeding these thresholds.

6.2 Resource Limits

Shared hosting accounts are subject to fair usage policies:

  • CPU usage: Maximum 25% for more than 90 seconds
  • Memory usage: As specified in your hosting plan
  • Inodes: Maximum 250,000 files per account
  • Database size: As specified in your hosting plan
  • Email sending: Maximum 500 emails per hour
6.3 Scheduled Maintenance

Scheduled maintenance will be announced at least 24 hours in advance via email and our status page. Emergency maintenance may be performed without notice when necessary for security or stability.

6.4 Network and Infrastructure

We maintain redundant network connections and backup power systems. However, we are not liable for downtime caused by factors beyond our control including natural disasters, ISP issues, or third-party service failures.

7. Data Management, Backups, and Security

7.1 Data Backup Policy

We perform automated backups for disaster recovery purposes only. These backups:

  • Are not guaranteed to be available or restorable
  • May not include all data or recent changes
  • Are not a substitute for your own backup strategy
  • May be retained for up to 30 days at our discretion

You are solely responsible for maintaining your own backups and data recovery plans.

7.2 Data Security

We implement industry-standard security measures including firewalls, intrusion detection, and regular security updates. However, you are responsible for:

  • Keeping your applications and scripts updated
  • Using strong passwords and secure authentication
  • Properly configuring file permissions
  • Monitoring your account for suspicious activity
7.3 Data Retention and Deletion

Upon account termination, data will be retained for 30 days for shared hosting and 7 days for VPS/dedicated services. After this period, all data will be permanently deleted and cannot be recovered.

7.4 SSL Certificates

Free SSL certificates are provided for basic encryption. Premium SSL certificates are available for purchase. You are responsible for ensuring SSL certificates remain valid and properly configured.

8. Suspension and Termination

We reserve the right to suspend or terminate accounts immediately without notice for:

  • Violation of these Terms of Service
  • Illegal activities or content
  • Security threats or malicious behavior
  • Non-payment of fees
  • Excessive resource usage
  • Hosting nulled, pirated, or unauthorized software

Upon termination for cause, no refunds will be provided and all data may be permanently deleted. We will attempt to provide reasonable notice when possible, but immediate termination may occur for severe violations.

9. Limitation of Liability

Hero Servers' total liability for any claims arising from or related to our services is limited to the amount paid for services in the preceding 12 months. We are not liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages resulting from third-party actions
  • Service interruptions or data loss
  • Security breaches beyond our reasonable control

Our services are provided "as is" without warranties of any kind, express or implied.
