1. Agreement Overview

This Terms of Service agreement ("Agreement") governs your relationship with Hero Servers ("Company," "we," "us," or "our") when using our hosting services, website, and related products ("Services"). By creating an account or using our Services, you ("Customer," "you," or "your") agree to these terms. If you disagree with any part of these terms, you must discontinue use immediately.

1.1 Additional Policies

Your use of our Services is also governed by our Privacy Policy, Acceptable Use Policy, and any service-specific agreements, which are incorporated into this Agreement by reference.

2. Service Description

Hero Servers provides web hosting, VPS hosting, domain registration, and related services. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice to customers.

3. Account Eligibility and Registration

3.1 Age and Authority Requirements

You must be at least 18 years old to register for our Services. If registering on behalf of a business or organization, you warrant that you have authority to bind that entity to this Agreement.

3.2 Accurate Information

You must provide truthful, current, and complete registration information, including a valid email address different from any domain you're registering with us. Providing false information may result in immediate account termination.

3.3 Account Security

You are fully responsible for maintaining account security and all activities under your account. We may require government-issued identification for verification purposes, especially for dedicated servers or high-value orders.

3.4 Multiple Account Restrictions

Creating multiple accounts to abuse new customer promotions is prohibited. Violating accounts will be suspended until all outstanding balances are resolved.

5. Payment Terms and Refunds

5.1 Payment Requirements

All services must be paid in advance. We accept major credit cards, PayPal, and other approved payment methods. Prices are subject to change with 30 days notice to existing customers.

5.2 Billing Cycles and Auto-Renewal

Services are billed according to your chosen billing cycle (monthly, quarterly, annually). All services auto-renew unless cancelled before the renewal date. You are responsible for keeping payment information current.

5.3 Late Payments and Suspension

Accounts with overdue payments will be suspended after a 7-day grace period. Suspended accounts may be terminated after 30 days. A reactivation fee may apply for suspended accounts.

5.4 Refund Policy

We offer a 30-day money-back guarantee for new hosting accounts only. Refunds exclude:

5.5 Chargebacks and Disputes

Initiating a chargeback without contacting support first may result in immediate account termination. We reserve the right to charge a $25 fee for each chargeback processed.

6. Service Level Agreement and Technical Specifications

6.1 Uptime Guarantee

We guarantee 99.9% uptime for shared hosting and 99.95% for VPS/dedicated services. Uptime is calculated monthly excluding scheduled maintenance. SLA credits may be available for verified downtime exceeding these thresholds.

Scheduled maintenance will be announced at least 24 hours in advance via email and our status page. Emergency maintenance may be performed without notice when necessary for security or stability.

6.4 Network and Infrastructure

We maintain redundant network connections and backup power systems. However, we are not liable for downtime caused by factors beyond our control including natural disasters, ISP issues, or third-party service failures.

7. Data Management, Backups, and Security

Upon account termination, data will be retained for 30 days for shared hosting and 7 days for VPS/dedicated services. After this period, all data will be permanently deleted and cannot be recovered.

Free SSL certificates are provided for basic encryption. Premium SSL certificates are available for purchase. You are responsible for ensuring SSL certificates remain valid and properly configured.

We reserve the right to suspend or terminate accounts immediately without notice for:

Suspended accounts may be reinstated upon resolution of the violation and payment of any applicable reinstatement fees. Accounts terminated for illegal activities, nulled software, or severe policy violations will not be eligible for reinstatement.

9. Limitation of Liability

Hero Servers' total liability for any claims arising from or related to our services is limited to the amount paid for services in the preceding 12 months. We are not liable for:

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet infrastructure failures.

15.1 Domain Registration

Domain registrations are subject to registry policies and ICANN regulations. We act as a reseller and are not responsible for registry decisions or domain disputes.

15.2 Domain Renewals

Domain renewals are your responsibility. We will send renewal notices but are not liable for expired domains. Expired domains may be subject to redemption fees or permanent loss.

Domain transfers are subject to registry requirements and may take 5-7 days to complete. Transfer fees are non-refundable once the process begins.

16. Reporting Violations

If you become aware of any violations of these terms, please report them immediately to abuse@hero-servers.com. We investigate all reports and take appropriate action within 24-48 hours.

17. Severability and Entire Agreement

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force. These terms constitute the entire agreement between you and Hero Servers regarding our services.

18. DMCA and Copyright Policy

We comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please send a DMCA takedown notice to dmca@hero-servers.com with:

19. Reseller and White Label Restrictions

Reselling our services without written authorization is prohibited. White label or rebranding of our services requires a separate reseller agreement. Unauthorized reselling may result in immediate termination.

20. Server Location and Data Jurisdiction

Our servers are located in multiple jurisdictions. Data may be processed and stored in countries different from your location. By using our services, you consent to international data transfers as necessary for service provision.

21. Bandwidth and Storage Limits

"Unlimited" plans are subject to fair usage policies. Accounts consistently exceeding normal usage patterns may be migrated to appropriate plans or suspended. We define normal usage as typical business or personal website operations.

22. Third-Party Integrations

We may integrate with third-party services (CDNs, DNS providers, etc.). We are not responsible for third-party service failures, data breaches, or policy changes that may affect your service.

23. Account Transfer and Ownership

Account ownership transfers require written authorization from both parties and verification of identity. Domain transfers are subject to registry requirements and may incur additional fees.

24. Service Credits and Compensation

Service credits for verified downtime exceeding SLA thresholds will be calculated as a percentage of monthly fees. Credits must be requested within 30 days and cannot exceed 100% of monthly service fees.

25. Beta and Experimental Features

Beta features are provided "as-is" without warranties. We may discontinue beta features at any time without notice. Use of experimental features is at your own risk.

26. API and Automation Usage

API access is subject to rate limits and fair usage policies. Automated tools must not interfere with server performance or other users. API abuse may result in access restriction or account suspension.

27. Email Services and Anti-Spam

Email services must comply with CAN-SPAM Act and international anti-spam laws. Bulk email requires prior approval. We maintain blacklists and may restrict email sending for policy violations.

28. Disaster Recovery and Business Continuity

While we maintain disaster recovery procedures, customers are responsible for their own business continuity planning. We recommend maintaining off-site backups and alternative hosting arrangements.

29. Survival Clause

Sections relating to payment obligations, intellectual property, limitation of liability, indemnification, and dispute resolution shall survive termination of these terms.
